Separate and dissenting opinions: their role in the practice of the ICJ

The purpose of the thesis is to draw attention to the significance of the individual opinions in the practice of the International Court of Justice. The author aims to define the actual role of individual opinions in the system of work of the International Court of Justice by means of analyses of individual opinions appended to the Court’s judgements, rendered under contentious and advisory jurisdiction of the Court. In this thesis possible solutions proposed of how the existence of individual opinions should be regulated in the basic documents of the International Court of Justice.

The paper analyses the judgment of the International Court of Justice of November 11, 2013, in which the Court establishes several factors relevant for the interpretation of its judgments. After illustrating the importance of this judgement, the paper criticizes the Court's refrain from any examination of subsequent practice of the Parties in the application of its judgments, as a means of interpretation. How is it possible to regard something that is not prohibited, as illegal? What are the resulting consequences of fact and law? This chapter suggests that a reasonable way to reconcile these two assertions is to admit that they refer to two profiles of the phenomenon in question that must be kept separate. Independence is not prohibited, but not all means to reach it are allowed under general international law. This paper examines some issues raised by the United States withdrawal from the Joint Comprehensive Plan of Action (JCPOA) related to Iran’s nuclear program. The JCPOA is a nonbinding document, there has been some debate about the effect of the subsequent U.N. Security Council resolution endorsing the document on its legal status and on the US faculty of unilaterally withdrawing from the plan of action. Iran brought a case before the International Court of Justice questioning the legality of the reintroduction of U.S sanctions, the Court could eventually address the issue in later phases. This contribution focuses on the application of the crime of genocide by international tribunals, mainly the International Criminal Tribunal for Rwanda, the International Criminal Tribunal for the former Yugoslavia and the International Court of Justice. The constituent elements of the crime of genocide are analyzed according to the jurisprudence of these international tribunals.
